Effective Date: October 29, 2026
1. Introduction
Cape Fear Solar Systems, LLC, doing business as Cape Fear Energy Systems (“Cape Fear Energy,” “we,” “us,” or “our”), is a solar, battery, generator, EV charging, and HVAC installer headquartered at 910 S 2nd Street, Wilmington, NC 28401. We serve homeowners and businesses in North Carolina and South Carolina. This Privacy Policy explains what personal information we collect through our website, forms, estimate tools, and customer communications, how we use it, and when we share it. By using www.capefearenergy.com or providing information to us, you agree to the practices described here.
2. Information We Collect
Information you provide. When you submit a form on our website (including requests for a free estimate, contact forms, service requests, and referrals), or when you sign up with us, we may collect your name, phone number, email address, electric utility provider, street address, city, state, and ZIP code. We also collect your average monthly electric bill amount, which we use to size and estimate your system. This is the only financial information we collect directly from you through our website. For customers, we may also collect additional details needed for their project, such as roof information, property details, and photos.
Information from our estimate tools. Our satellite-based solar estimate tool, provided by DemandIQ, stores the property address you enter and may collect other information needed to generate your estimate. DemandIQ may also collect additional information you enter into its forms.
Information needed for customer projects. After you sign a sales contract with us, we prepare permitting and utility interconnection documents on your behalf. These documents may include your name, address, contact details, utility account information, system specifications, and other information required by your utility, local permitting office, or incentive program.
Financing information. If you apply for financing, you complete application forms sent to you by one of our financing partners. We do not collect or store those forms ourselves. The financing partner processes that information under its own privacy policy.
Automatically collected information. When you visit our website, we and our service providers may collect information such as your IP address, browser type, device information, pages you view, and the date and time of your visit, using cookies and similar technologies. See Section 5 below.
Communications. If you communicate with us by phone, email, text, or through our website, we keep a record of those communications so we can respond and manage your project.
3. How We Use Your Information
We use personal information to:
- respond to your estimate requests, questions, and service requests;
- design, price, permit, and install your energy system;
- prepare utility interconnection and incentive or rebate paperwork;
- coordinate financing you choose to pursue;
- provide warranty, maintenance, and customer support;
- send project updates, including technician arrival and scheduling notices;
- send marketing emails where you have agreed to receive them;
- maintain records of our work, including warranty records and our “do not contact” list;
- analyze and improve our website, marketing, and services;

4. How We Share Your Information
We do not sell or rent your personal information to anyone. We share information only as described below:
- Service providers that help us run our business, including HubSpot and Zoho (customer relationship management, website forms, and email campaigns), DemandIQ (satellite solar estimates), and analytics providers. These providers may use the information only to perform services for us.
- Financing partners, when you apply for or use financing for your project.
- Utilities, permitting offices, and incentive programs, when needed to complete your interconnection, permitting, or rebate applications for your project.
- Subcontractors who help install or service your system, only as needed for that work.
- Legal and safety purposes, when we believe disclosure is required by law, legal process, or government request, or is needed to protect the rights, property, or safety of Cape Fear Energy, our customers, or others.
- Business transfers. If our business is sold, merged, or reorganized, personal information may be transferred as part of that transaction. We will notify you if this happens and your information becomes subject to a different privacy policy.

6. Text Messages
Customers. If you have signed a contract with us, we may send you automated and manual text messages about your project, such as technician arrival times, installation scheduling, service visits, and warranty or account notices. These messages are informational and are not marketing. By providing your mobile number in connection with your contract, you consent to receive them. 7. Do Not Contact Requests and Record Retention
If you ask us to stop contacting you, we will honor that request and add your information to a “do not contact” list so we don’t contact you again in that way. We keep this limited record to comply with your request.
We keep customer records for as long as needed to provide our services, honor warranties on our work, and meet legal, tax, permitting, and record-keeping obligations. We do not delete customer records unless you ask us to, and we will consider the legal and warranty reasons for keeping records before doing so. Lead information that does not become a customer is kept for a reasonable time for follow-up and then deleted or anonymized, unless you ask us to remove it sooner.
8. Data Security
We use reasonable administrative, technical, and physical safeguards to protect personal information, including access controls and secure systems provided by our service providers. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If we become aware of a security breach affecting your personal information, we will notify you as required by applicable law.
9. Your Choices and Rights
You may contact us to:
- ask what personal information we hold about you;
- request a correction to inaccurate information;
- ask us to delete your information, subject to the record-keeping and warranty needs described in Section 7;
